Terms of Service

Article 1 (Applicability)

These Terms of Service (the "Terms") apply to all users of the international shipping services (the "Service") provided by Globy Co., Ltd. (the "Company") using Japan Post's Express Mail Service (EMS).

Article 2 (Eligibility)

The Service is available to individuals who are 18 years of age or older. Minors must obtain the consent of a parent or legal guardian to use the Service.

Article 3 (Prohibited Items and Country Restrictions)

  • Items prohibited under Japan Post’s EMS regulations and Universal Postal Union (UPU) guidelines cannot be shipped through the Service. These include, but are not limited to:

    • Hazardous, flammable, or explosive materials (e.g., lithium batteries not installed in devices, perfume, aerosol cans)

    • Living creatures or plants

    • Valuable goods (e.g., cash, banknotes, precious metals, jewels)

    • Perishable or refrigerated goods

    • Illegal goods, contraband, or items prohibited by the laws or customs regulations of Japan or the destination country

  • It is the user's responsibility to confirm whether the destination country restricts or prohibits the import of the contents before using the Service. The Company shall not be liable for any disposal, confiscation, detention, or return of items by customs authorities in the destination country due to local import restrictions.

Article 4 (Limitation of Liability and Compensation)

  • The Company shall not be liable for any delays, damage, or loss caused by events beyond our reasonable control, including but not limited to natural disasters, war, customs clearance delays, or transport disruptions.

  • In the event of damage or loss caused by the Company's direct negligence, compensation shall be provided in accordance with the standard EMS compensation system up to a maximum of ¥20,000 per shipment, based on the actual value of the contents.

  • If the user wishes to obtain compensation exceeding ¥20,000, they must declare the value of the contents in advance and pay the required additional premium specified by the Company. In such cases, the maximum compensation shall be limited to the declared value (up to a maximum of ¥2,000,000).

Article 5 (Customs Duties and Additional Fees)

  • Customs duties, consumption taxes, import taxes, and customs clearance fees that may be incurred in the destination country are NOT included in the Service fees. All such destination-country taxes and fees must be paid entirely by the recipient (or the user).

  • Depending on the declared value of the contents, additional fees such as insurance premiums and export customs clearance agency fees may apply in accordance with the Company’s tariff schedule. The user shall agree to pay these additional fees upon request.

  • If the recipient refuses to receive the shipment due to customs duties or other local expenses, the shipment may be returned or abandoned. In such cases, the Company shall not provide any refunds.

Article 6 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the Kyoto District Court in the first instance.
